My answer is the same as Vickie. We do not add Marijuana or Cannabis to our med list. Because it is not legal from a federal standpoint, we have received guidance not to add to the med list.

After the MHCA Annual Meeting, Kathy Lucas went back and got us answers to some of the questions she was unable to answer during her session. One was on whether or not agencies should put marijuana on the
med list. Below is her response. Is this different than what your agency is currently doing?
If Marijuana is a prescribed medication it should be included on the medication list. See 484.55 below.
In addition, if the agency is aware that the Patient is using Marijuana or any other substance that is not prescribed, this should also be included on the patient’s 485/orders as a note to inform the physician
as this may affect the treatment plan for the patient
§484.55(c)(5) A review of all medications the patient is currently using in order to identify any potential adverse effects and
drug reactions, including ineffective drug therapy, significant side effects, significant drug interactions, duplicate drug therapy, and noncompliance with drug therapy.
Interpretive Guidelines §484.55(c)(5)
The patient’s clinical record should identify all medications that the patient is taking (both prescription and non-prescription) as well as times of medication administration
and route. As part of the comprehensive assessment the HHA nurse should consider, and the clinical record should document, that the HHA nurse considered each medication the patient is currently taking for possible side effects and the list of medications in
its entirety for possible drug interactions. The HHA should have policies that guide HHA clinical staff in the event there is a concern identified with a patient’s medication that should be reported to the physician.
