I feel that you wrote it out well and it is easy to understand. I slide that I felt was helpful on the webinar I saw had the information laid out this way:

“New Limits on non-inpatient encounters”

 42.CFR 424.22 (a) (1) (v)

               ( c ) The face-to-face encounter must be performed by the certifying physician or allowed practitioner unless the encounter is performed by:

1. A certified midwife as described in paragraph (a) (1) (v) (A) (4) of this section
2. A physician, physicians assistance, nurse practitioner, or clinican nurse specialist with privileges who cared for the patient in the acute or post-acute facility from which the patient was directly admitted to home health and who is different from the certifying practitioner.

• Inpatient is defined to include services provided in a hospital or other institutional setting when the patient comes “Directly” to home health
• “directly” is not defined in the regulatory guidance
• Encounters in the ED or hospital observation stay can be used for face to face as “inpatient” encounters.
