One suggestion, they need to give a notice that the person does not qualify any longer. Therefore, they should honor at least 10 days past when the agency was notified.

I had this scenario several years ago and during the appeal process  the service agreement stayed in place but a modifier was added to the SA. DHS should be able to advise on the particular modifier, U5 or U6 possibly. Once the decision is made the hours will end or change effective on the date of the appeal hearing. This particular person was straight MA, so I'm not sure how a waiver would play into this scenario but I would advocate with the case manager or mco that they need to at least honor any hours from 10 days after the agency was notified.

Long story but details:

8/27 Assessment was completed

9/15 we received PCA Service Agreement via MN-ITS mailbox for 10/1/24-9/30/25

10/1, we began emailing the county worker to get the assessment documents

10/28 – county worker responded that per the assessment the client no longer qualifies for PCA and they are shutting down SA and they want us to do take backs

 

We reached out to client immediately to find out if they were aware of this, and of course, this was the first they’d heard of it.  They have not received anything.  Client has had PCA services for a very LONG time, but this assessor determined that based on the client’s responses he no longer needs any help. 

 

I know Heidi from MN DHS at the MHCA conference stated they’re were some issues with assessments. . .we’ve had reduction in hours for most, but not any removing the service completely.  Any resources you are aware of that we can pass along to the client, is greatly appreciated.  The county worker just told the client’s PCA they need to do an appeal but no further information or assistance since he is no longer her client since he doesn’t qualify   Thank you!
