The short answer is no. They are beating around the bush and you can’t bill a nurse visit unless they performed a skilled task. Supervision of personal care aides is not a skilled task. So there is always this double answer to this question
and we have asked many times to many organizations but that is the final word. To my knowledge, this has not changed. I find it unfortunate. The payer VA always says we can bill something per their request but that doesn’t let us off the hook for following
the rules of our licensure in our state. We went through this with HHA and homemaking services. They said we can bill it all under HHA but then that is in violation of our license requirements so we technically cannot and should not.

I asked the MHCA Consultant this:
Q: If a client is on Medicaid (or Veteran Benefit) for aide only services, can we bill for the SN recert and direct supervisory visits?
But we are now receiving prior authorization form the veteran providers stating "when required by state regulation, skilled nurse visits for oversight of respite/aide
are allowed.
Maximum of 16 oversight visits".
This is the answer I got from MHCA consultant:
For MA, we can't bill for aide supervision or recert visits.
To be honest, I am not sure regarding VA. The only way to find that out would be to call directly and ask. They tend to change things frequently so I do not know what the policy is
on that right now.
Another thing you could do is to reach out to other MHCA members on the billers listserv.
